Terms of SERVICE & CONDITIONS

Welcome to Playmakers Nashville (“Playmakers,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, memberships, events, continuing education programs, donations, and related services (collectively, the “Services”).

By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use our Services.

1. Eligibility

You must be at least 18 years old to create an account or purchase a membership unless participating through a parent, guardian, or authorized organization.

By registering, you represent that:

  • the information you provide is accurate and complete, and
  • you have the legal capacity to enter into this agreement.

2. Membership

Registration

Members must provide accurate and current information and keep their login credentials confidential.

Approval

Playmakers Nashville reserves the right to approve, deny, suspend, or revoke membership at its discretion to protect the integrity, safety, and mission of the organization.

Member Conduct

Members agree to:

  • act professionally and respectfully
  • comply with our Code of Conduct
  • not misuse member directories or contact information

We may suspend or terminate membership for violations.

3. Payments, Fees, and Donations

Fees

Membership fees, event fees, and program fees must be paid through our designated secure payment platforms.

Donations

Donations are voluntary and generally non-refundable. Donors should consult a tax advisor regarding deductibility. Playmakers Nashville will provide receipts as required by law.

Refunds

Unless otherwise stated:

  • Membership fees are non-refundable
  • Donations are non-refundable
  • Event/program fees may be refundable only if Playmakers cancels the event

We reserve the right to issue refunds at our discretion.

Third-Party Processors

Payments are processed by third-party providers (e.g., Neon CRM, Stripe, PayPal). We are not responsible for processor errors or outages.

4. Continuing Education Programs

Playmakers may offer educational programming or professional development opportunities.

We:

  • do not guarantee licensure, certification, or employment outcomes
  • do not guarantee that credits will be accepted by all professional bodies

Participants are responsible for confirming eligibility or accreditation requirements with their own licensing or governing authorities.

5. Events & Participation

Assumption of Risk

Participation in in-person or virtual events is voluntary. You assume all risks associated with attendance, including personal injury, illness, or property damage.

Release

To the fullest extent permitted by law, you release Playmakers Nashville from liability arising from event participation, except for gross negligence or willful misconduct.

Removal

We may remove individuals from events without refund for disruptive, unsafe, or inappropriate behavior.

6. Photos, Videos, and Media Release

By attending events or uploading headshots or other media, you grant Playmakers Nashville permission to photograph, record, and use your likeness for organizational, educational, or promotional purposes (including website, social media, newsletters, and marketing materials), unless you notify us in writing otherwise.

This permission is voluntary and may be revoked by contacting us.

We will not sell or license member images to third parties.

7. Acceptable Use of Website

You agree not to:

  • violate laws
  • scrape or harvest data
  • attempt unauthorized access
  • interfere with site functionality
  • distribute malware
  • misuse member information

We may suspend access for violations.

8. Intellectual Property

All content, trademarks, logos, materials, and resources on our Services are owned by or licensed to Playmakers Nashville.

You may not copy, distribute, modify, or use our materials without written permission, except for personal, non-commercial use.

9. Third-Party Services and Links

Our Services may integrate with or link to third-party platforms. We are not responsible for their content, policies, or practices.

Your use of those services is governed by their terms.

10. Privacy

Your use of our Services is also governed by our Privacy Policy, which explains how we collect and use personal information.

11. Disclaimer of Warranties

Services are provided “as is” and “as available.”
We do not guarantee uninterrupted, error-free, or secure operation.

12. Limitation of Liability

To the fullest extent permitted by law, Playmakers Nashville shall not be liable for indirect, incidental, special, or consequential damages arising out of your use of the Services.

Our total liability shall not exceed the amount paid by you to us in the preceding twelve (12) months.

13. Indemnification

You agree to indemnify and hold harmless Playmakers Nashville and its directors, officers, volunteers, and employees from claims arising out of:

  • your misuse of Services
  • your violation of these Terms
  • your conduct at events

14. Termination

You may cancel your membership at any time.

We may suspend or terminate access for violations or conduct inconsistent with our mission or safety.

Certain provisions (liability limits, IP, indemnification) survive termination.

15. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.

Any disputes shall be resolved in the state or federal courts located in Nashville, Tennessee.

16. Changes to Terms

We may update these Terms periodically. Continued use of our Services after changes constitutes acceptance.
